This is a proposed amendment to the Constitution.
1. No person shall be compelled to join any labor organization or affiliation as a condition of qualifying for, obtaining, or retaining employment, nor shall any person suffer harm who at any time declines or discontinues representation by, membership of, or affiliation with the same.
2. Whereas public employees are paid from public funds; the positions of public employees exist only to serve the people; public employees do not enjoy rights and privileges above any other person; and working conditions and compensation of public employees may be established, monitored, and modified by the elected representatives of all the people; therefore, union representation and collective bargaining of and for public employees by any labor organization or collective bargaining unit is hereby prohibited.
3. This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the several States, as provided herein.
