Congressional Ethics


This is a proposed amendment to the Constitution.

1. Members of Congress are prohibited from engaging in activities which attempt to influence any public official on behalf of or against proposed legislation or any public policy for five years after their terms end.
2. Total compensation for members of Congress shall be determined following each decennial census, and shall be revised upwards or downwards, according to the median income, excepting the topmost and lowermost one percentiles, within the United States at that time, among the several states, and shall not exceed two times that number.
3. No elected official in or under the United States may stand for concurrent election to more than one office.
4. No member of Congress, having been selected as his party’s nominee for President or Vice-President, may retain his office beyond the date of acceptance of the nomination, or, if not subject to official nomination by his party, beyond the date when he declares himself a candidate for President or Vice-President.
5. No elected official shall receive any salary or other compensation from public funds for time spent engaging in election campaign activities if such activities interfere with or take place during those times when the governing body or office to which he has been elected is conducting its business; nor shall any activity which includes either endorsement of or denouncement of a political party or candidate be exempt from this provision.
6. The States may determine methods for the people to effect the recall of their delegates to Congress.
7. This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the several States, as provided herein.

Revised 1/21/2011: Clarified prohibition against concurrent candidacies to include elected officials at all levels of government within the US; limited requirement to surrender office if nominated for President or Vice-President to members of Congress so as to avoid a Constitutional crisis wherein a sitting President or Vice-President would be required to resign if seeking re-election.
